Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of khelam.space and the Khelam application (collectively, the "Platform"), operated by Khelam ("we", "us", "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 13 years old to create an account. If you are under 18, you confirm you have permission from a parent or guardian to use the Platform. By using the Platform, you represent that you have the legal capacity to enter into these Terms.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information when creating your profile and to keep it up to date.
• You may sign in using Google OAuth or an email/password combination. You are responsible for securing the email account associated with your Khelam account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. What Khelam is — and isn't

Khelam helps players find sports venues, record their intent to book a slot, track match scores, and organize tournaments. Khelam helps venue owners list their facilities so players can find them.

All actual payment for venue bookings happens directly between the player and the venue, by whatever method the venue accepts (cash, UPI, card, etc.), entirely outside the Khelam platform. Khelam is not a party to that transaction and bears no responsibility for pricing accuracy, venue availability, refunds, or service quality at the venue.

5. Venue bookings & payments

Cancellation & rescheduling

• Each venue sets its own notice period for cancelling or rescheduling a booking through Khelam. The applicable notice period is shown when you manage the booking.
• Once that notice period has passed, the booking can no longer be cancelled or rescheduled in the app. You must contact the venue directly.
• Rescheduling is limited to a different time at the same venue, subject to availability, and to a maximum of two reschedules per booking. Venues may disable rescheduling entirely.
• Cancelling or rescheduling in the app changes the slot record only. Any refund of money already paid to the venue is governed by that venue's own policy and is settled directly between you and the venue — see our Refund Policy.

Payments made through UPI links in the app

• Any advance amount shown is set by the venue, not by Khelam.
• After paying, you enter the UPI reference number (UTR). This creates a record of a claimed payment — it is not verification. The venue confirms or rejects it after checking their own account.
• Submitting a false, incorrect or reused payment reference is a breach of these Terms and may result in immediate suspension of your account.
• If a payment is rejected by the venue, the booking is cancelled and the slot released. Any money genuinely transferred remains a matter between you and the venue.
• Khelam is not responsible for failed, delayed, duplicated or misdirected UPI transfers, for payments sent to an incorrect UPI ID, or for any dispute about whether payment was received. Payment records shown in Khelam are a convenience record only and are not tax invoices.
• Venue owners are responsible for the accuracy of the UPI ID and QR code they publish, and for issuing any tax invoice or GST documentation required by law.

• When you "book" a slot through Khelam, you are recording your intent to use a venue at a given time. This is not a payment, deposit, or guaranteed reservation enforced by Khelam.
• You are responsible for confirming availability and finalizing payment terms directly with the venue.
• Venue pricing, operating hours, amenities, and policies displayed on Khelam are provided by the venue owner. Khelam does not independently verify this information and is not liable for inaccuracies.
• Disputes about a booking, payment, cancellation, or refund for a venue visit must be resolved directly between you and the venue. Khelam may, at its discretion, assist in facilitating communication but is under no obligation to mediate or resolve such disputes.

6. Venue owner listings & subscriptions

• Venue owners who list a venue on Khelam are responsible for the accuracy of all information provided, including pricing, contact details, amenities, and policies.
• Subscription plans (Starter, Pro, Enterprise) and any associated fees or commission rates are as described on the venue listing page at the time of signup, and may change with notice.
• Payment for subscription plans is currently collected manually outside the Platform (e.g. via bank transfer or UPI) and tracked by our team; this will transition to automated billing once supported.
• We reserve the right to remove or suspend any venue listing that contains inaccurate, fraudulent, or inappropriate information, or for non-payment of applicable fees.

7. Open games & playing with other users

Khelam lets users post "open games" and join games posted by others. By using this feature you acknowledge and agree that:

• Khelam does not verify users. We do not perform background checks, identity verification, skill assessment, or age verification on anyone who hosts or joins a game. You are solely responsible for deciding whom you meet and play with.
• Assumption of risk. Physical sport involves inherent risks including injury, disability and, in rare cases, death. You voluntarily assume all such risks, and confirm you are medically fit to participate.
• Meeting in person. Games take place at third-party venues or locations chosen by users. Khelam is not a party to any meeting, has no control over the location or conduct of participants, and makes no representation about safety.
• Your own arrangements. Any cost sharing, equipment, transport, insurance or medical cover is arranged between participants, not by Khelam.
• Report concerns. If a user behaves inappropriately, report them to us and we may suspend their account. Contact local emergency services first in any urgent situation.

We recommend meeting at established public venues, telling someone where you are going, and not sharing personal financial information with other users.

8. Acceptable use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law in India, the United States, or your local jurisdiction.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload false, misleading, or fraudulent venue, match, or tournament information.
• Attempt to gain unauthorized access to the Platform, other accounts, or any connected systems.
• Harass, abuse, or harm other users.
• Use automated means (bots, scrapers) to access the Platform without our written permission.

9. User content

You retain ownership of content you submit (profile information, team names, match data, venue listings, etc.), but you grant Khelam a worldwide, non-exclusive, royalty-free license to use, display, and store that content as necessary to operate the Platform's features (e.g. showing your match results to other players, displaying your venue listing publicly).

You are solely responsible for the content you submit and confirm you have the right to submit it.

Reviews

• You may only review a venue where you had a confirmed booking. Reviews must be honest, based on your own experience, and must not contain false statements of fact, abuse, or personal information about individuals.
• Reviews express the opinions of individual users, not of Khelam. We do not endorse or verify their accuracy.
• We may remove reviews that breach these Terms, appear fraudulent, or are the subject of a credible legal complaint, but we are not obliged to monitor or remove content.

Photographs

• By uploading a photograph you confirm you own it or have permission to use it, and that it does not infringe anyone's rights or contain identifiable individuals who have not consented.
• Photographs of venues are displayed publicly, including to visitors without a Khelam account.
• If you believe content on Khelam infringes your rights, email us at support@khelam.space and we will review and, where appropriate, remove it.

Public visibility

Player names, statistics, team names, match results, venue listings and reviews are displayed publicly on khelam.space and may be indexed by search engines. See our Privacy Policy for details and how to opt out of a public profile.

10. Intellectual property

The Khelam name, logo, and the Platform's software, design, and underlying technology are owned by Khelam or its licensors and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Khelam's trademarks without prior written consent.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that venue information displayed is accurate or current.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KHELAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE PLATFORM, INCLUDING ANY DISPUTE, TRANSACTION, PERSONAL INJURY, PROPERTY DAMAGE OR DEATH ARISING FROM A VENUE BOOKING OR VISIT, FROM AN OPEN GAME OR ANY MEETING WITH ANOTHER USER, OR FROM CONTENT POSTED BY USERS.

Khelam's total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount, if any, you paid to Khelam directly in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Khelam, its founders, and personnel from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party, including a venue or another player.

14. Termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access to the Platform at our discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, third parties, or Khelam.

15. Governing law

For users located in India, these Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

For users located in the United States, these Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles, except where local consumer protection law requires otherwise.

16. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or an in-app notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
